If you miss a court date for a DUI in Michigan, two things happen fast. The judge issues a bench warrant for your arrest, and the Secretary of State moves to suspend your driver’s license. A missed date is not a quiet mistake the court forgets.
It is treated as ignoring a judge’s order. The good news is that one missed appearance can usually be cleared up if you act quickly. A Michigan OWI defense attorney can get ahead of the warrant, protect your license, and keep one bad day from sinking the whole case.

A Bench Warrant Is Issued for Your Arrest
When you fail to appear, the judge issues a bench warrant. That warrant authorizes any police officer to arrest you on sight. It is entered into the statewide Law Enforcement Information Network, so it follows you everywhere in Michigan. Police will not usually come looking for you over a DUI warrant, but the next routine traffic stop, fender bender, or background check can land you in jail until you post bond or see the judge.
Michigan law builds in a short cushion the first time this happens. For a first failure to appear in the case, the court must generally wait 48 hours before issuing the warrant, to give you a chance to come in on your own. That cushion is not guaranteed, though.
The judge can issue the warrant immediately when the missed date was your sentencing, when a new crime is suspected, or if witnesses were already in the courtroom. It also does not apply at all if you have previously missed a date in the same case.
A common assumption is that a bench warrant just sits in a file until your next court date. It does not. The warrant is active the moment it is signed, and so is the license suspension that comes with it.
The Secretary of State Suspends Your License
A DUI charge is treated more seriously than an ordinary ticket when you miss court. Under Michigan’s failure-to-appear law, a missed appearance on an operating-while-intoxicated charge puts you on the fast track. The court sends notice by first-class mail, and if you do not appear within 7 days or resolve the matter within 14 days, it informs the Secretary of State, which then suspends your driver’s license.
Note that, for most non-DUI tickets, that clock runs a bit longer.
This suspension is separate from any license penalty the DUI itself might carry. It can hit even before your case has ever been decided. And because the suspension flows from the missed date, you cannot simply wait it out.
Clearing it takes two steps:
- The court has to notify the Secretary of State that you have appeared to answer the matter; and,
- You must pay the court a $45 driver license clearance fee for each failure.
Once those are done, the hold lifts. If you get caught driving in the meantime, that will create a whole new Driving While License Suspended (DWLS) charge, so that’s one more reason to deal with a missed date right away rather than hoping it goes unnoticed.
Your Bond and Your Defense Both Take a Hit
If you posted money or a bond to be released, missing court puts it at risk. Once the warrant is issued, the judge can revoke your release and order the bond forfeited. If someone posted it for you, in their name, that means they can lose their money.
The quieter damage is to your defense. Up to the moment you missed court, you may have had some real leverage, such as a questionable traffic stop, a breath test worth challenging, or room to negotiate down to a lesser charge. A missed date hands the prosecutor and the judge a reason to doubt you and possibly even set a higher bond.
The ultimate goal in every DUI case is to get the whole thing dismissed. If the evidence is strong enough to prevent that, the focus shifts to negotiating a plea bargain and avoiding as many of the legal penalties and other negative consequences as possible. No matter how you cut it, success in a DUI case is best measured by what does NOT happen to you, and an avoidable warrant makes the best possible outcome harder to reach.
What to Do If You’ve Already Missed Your Court Date
The single most important thing is to act before the warrant turns into an arrest. Courts in Michigan understand that emergencies happen — and sometimes people just miss court for reasons that have nothing to do with the case. A judge who sees you taking responsibility quickly is far more likely to recall the warrant, set a new date, and leave your bond alone. The steps that help most are straightforward:
- Do not drive. Your license is likely already suspended, and a stop now means a new charge on top of the warrant.
- Gather proof of why you missed court, if there is a real reason, such as a hospital record, a death in the family, or evidence you were never properly notified.
- Call a lawyer before you call the court. Early explanations to a clerk or the judge can box in your defense later.
- Move fast, especially if the missed date was your first in the case, while the 48-hour window may still be open.
Handled right, a missed appearance is a problem you fix, not a sentence you serve. The best way to protect your license, now and down the road, is to keep the underlying case on track — which is exactly why a missed date is worth fixing fast, before it becomes anything bigger.
