On Aug. 18, 2020, just after 10:30 p.m., a Flint police officer struck the 53-year-old plaintiff with his patrol vehicle as the plaintiff rode his bicycle home from work in Flint.
The officer was responding to an emergency, traveling 79 mph in a 35-mph zone at the three-way intersection of West Court Street, Pershing Street and Corunna Road, without activating his sirens.
Because there was no audible warning, the plaintiff did not hear the patrol vehicle as he entered the intersection to turn left onto Corunna Road. The officer struck the plaintiff as a result, causing catastrophic, permanent brain damage, multiple fractures and other life-altering injuries that require round-the-clock care.
After 15 days of testimony, jurors returned a $3.7 million verdict, finding the City of Flint 51% liable for the crash. A judgment was entered for $1.35 million to account for present value for future non-economic and economic damages of the 51% owed to the plaintiff.
