Where a putative class action has been brought over the assessment of the actual cash value of the plaintiff’s automobile pursuant to an insurance policy issued by the defendant, summary judgment should be denied because a genuine dispute of material fact exists as to whether the defendant’s third-party vendor considered appropriate evidence when calculating the plaintiff’s ACV.
