Where (1) a jury found that medical bills relating to a plaintiff’s neck surgery were owing and overdue to the plaintiff and (2) the trial court awarded the plaintiff $11,797.65 in overdue allowable expense benefits, $1,547.65 in pre-judgment interest, $2,798.40 in penalty interest, $11,371.65 in taxable costs and $288,090 in counsel fees, statements by the plaintiff’s counsel referring to the drunkenness of the other driver in the subject accident were erroneous but the error was harmless.
